Rental Agreement & Terms of Service

Welcome to Fresh Start Tote Rental, LLC. By reserving, renting, accepting delivery of, or using our moving totes and related equipment, you agree to the following Terms of Service.

Rental Equipment
Fresh Start Tote Rental, LLC provides reusable moving totes and related moving equipment, including dollies, moving bags, labels, and accessories ("Equipment") for temporary rental.

Rental Period
The rental period begins on the scheduled delivery date and ends on the scheduled pickup date agreed upon at the time of booking.

Customers are responsible for all rented equipment during the rental period until the equipment has been returned and inspected by Fresh Start Tote Rental, LLC.

Payment Terms
Full payment is due before delivery unless otherwise agreed upon in writing.

Fresh Start Tote Rental, LLC reserves the right to cancel or postpone delivery if payment has not been received.

Delivery & Pickup
Customers must provide safe and reasonable access for delivery and pickup.
If delivery or pickup cannot be completed due to restricted access, unavailable customers, gated entry issues, unsafe conditions, or other circumstances beyond our control, additional service fees may apply.

 
Customer Responsibilities

Customers agree to:

• Use the equipment only for its intended moving and storage purposes.

• Keep all equipment secure and protected from theft, loss, misuse, and damage.

• Return all equipment in substantially the same condition as received, excluding normal wear and tear.

• Notify Fresh Start Tote Rental, LLC immediately if equipment is lost, stolen, or damaged.

Late Returns
Equipment not available for pickup on the scheduled date may be subject to additional rental or late fees.
Late fees may continue to accrue until all equipment has been returned or replacement costs have been paid.

Lost, Stolen, or Damaged Equipment
Customers are responsible for the replacement cost of any equipment that is lost, stolen, destroyed, or damaged beyond normal wear and tear.

Current replacement fees include:

• Moving Tote: $25 each

• Tote Lid: $10 each

• Dolly: $50 each

• ​Furniture Dolly: $50 each

• Moving Bag: $15 each
   

Replacement costs are subject to change based on market pricing.

Cleaning Fees
Equipment should be returned free of excessive dirt, debris, liquids, paint, chemicals, or other contaminants.
Excessive cleaning may result in additional cleaning charges.


Cancellation Policy

• Cancellations made 48 hours or more before the scheduled delivery date will receive a full refund.

• Cancellations made less than 48 hours before delivery may be subject to a cancellation fee.

• Same-day cancellations may not be eligible for a refund.

 
Limitation of Liability

Fresh Start Tote Rental, LLC shall not be liable for:

• Damage to personal property.

• Loss of contents stored within rented equipment.

• Delays caused by weather, traffic, accidents, equipment shortages, or events beyond our reasonable control.

• Any indirect, incidental, or consequential damages arising from the use of rented equipment.

Assumption of Risk
Customers acknowledge that moving and lifting activities involve inherent risks.

Customers assume all responsibility for the safe use of rented equipment and agree to exercise reasonable care when lifting, stacking, transporting, and handling totes and related equipment.

Indemnification
Customer agrees to indemnify, defend, and hold harmless Fresh Start Tote Rental, LLC, its owners, employees, contractors, and representatives from any claims, damages, injuries, liabilities, costs, or expenses arising from the customer's use of rented equipment.

Refusal of Service
Fresh Start Tote Rental, LLC reserves the right to refuse service, delivery, or rental requests at its sole discretion.

Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Florida.
 
Acceptance of Terms
By placing a reservation, making payment, accepting delivery, or using rented equipment, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
